Mediation, like the collaborative-practice approach, is an alternative to litigation for divorcing couples, as well as in certain other family-law disputes. It can be preferable when feelings run too high for a collaborative approach or the parties are too far apart on big issues.

The two parties seeking divorce—or other dispute resolution—engage a neutral mediator, who works with both parties. The mediator’s role is to facilitate communications; help identify needs and interests; and craft a durable agreement that works for the parties and any relevant family. The parties can choose mediation to resolve all issues or just some.

A mediated divorce, gained largely on one’s own terms, demands less time than litigation and costs less. The number of mediation sessions required depends on the issues involved and the individual circumstances of the case. Importantly, the agreement by mediation tends to last, with fewer conflicts or modifications.
