Advice and Negotiation
creative problem-solving

Trust and empathy

Many divorce cases are resolved through the traditional approach of interest-based negotiation. An initial consultation with an attorney identifies the issues to be addressed and possible solutions. If the opposing party has an attorney, the two  attorneys  draft and negotiate an agreement. The other side does not  need to have an attorney for the negotiation process to be successful.

Interest-based negotiation is focused on the client’s needs and desires. The relationship between client and attorney is open and based on trust that the attorney knows and understands what is important to the client. The attorney helps the client define and assess objectives, then works to achieve them. The result should be a durable agreement that is fair and provides certainty and autonomy for the client in the future.
